Timber Deed / Contract
The timber deed converted the negotiated sale into a legal conveyance of the designated timber and established the buyer's harvest and access rights. It also documented the $60,000 consideration, the designated parcels, retained hardwoods and the fact that some incidental damage was expected during logging.
The transaction was documented through a Timber Deed between the property owner and W. J. Sorrell Lumber & Pulpwood Co., Inc.
The deed states consideration of $60,000 and describes a clearcut of merchantable timber on the identified Tallapoosa County parcels.
It also gives the buyer rights and privileges needed to harvest the timber, including access using woods roads or trails needed for timber access. The deed makes those rights important beyond the simple act of cutting trees because logging requires moving heavy equipment and loaded trucks through the property.
The document also addresses timber to be retained. Selected hardwood trees were to be marked to leave, while the parties acknowledged that some incidental damage to other trees and vegetation could occur during the cutting operation.
Another significant provision is that the timber rights remain attached to the property for the duration of the deed, including if the underlying land were conveyed during that period.
For this experiment, the deed is an important reminder that a timber sale is not just a price agreement. It is a temporary transfer of significant rights to enter the property, cut timber and use the land to conduct a commercial logging operation. Those rights need to match what the landowner actually intends.
